Tìm hiểu nguyên tắc "quyền lực nhà nước là thống nhất, có sự phân công và phối hợp giữa các cơ quan nhà nước trong việc thực hiện các quyền lập pháp, hành pháp và tư pháp"

Trong mục IV Hệ thống chính trị và vai trò lãnh đạo của Đảng, khi đề cập đến vấn đề nhà nước, Cương lĩnh xây dựng đất nước trong thời kỳ quá độ (năm 1991) viết: "Nhà nước Việt Nam thống nhất ba quyền lập pháp, hành pháp và tư pháp, với sự phân công rành mạch ba quyền đó" (1). Tiếp tục tổng kết thực tiễn, hoàn thiện và phát triển quan điểm nói trên của Cương lĩnh trong điều kiện xây dựng nhà nước pháp quyền XHCN của dân, do dân và vì dân, Nghị quyết Đại hội đại biểu toàn quốc lần thứ VIII của Đảng khẳng định: "Quyền lực nhà nước là thống nhất, có sự phân công và phối hợp giữa các cơ quan nhà nước trong việc thực hiện các quyền lập pháp, hành pháp, tư pháp" (2). Đến năm 2001, với sáng kiến lập pháp của Ban chấp hành trung ương Đảng khóa IX, Quốc hội khóa X đã tiến hành sửa đổi, bổ sung một số điều của Hiến pháp năm 1992, trong đó đã thể chế các quan điểm nói trên của Đảng thành một trong những nguyên tắc tổ chức và hoạt động của bộ máy nhà nước pháp quyền XHCN Việt Nam. Đây là một trong những quan điểm và là nguyên tắc cơ bản chỉ đạo công cuộc cải cách, xây dựng bộ máy nhà nước ta trong thời kỳ đổi mới; thể hiện sự phát triển mới về nhận thức lý luận của Đảng và nhà nước ta trong quá trình tổ chức và thực hiện quyền lực nhà nước thuộc về nhân dân.Tuy nhiên, là nguyên tắc mới, nên ý nghĩa và nội dung của nó không phải đã được nhận thức thống nhất, vận dụng đầy đủ và đúng đắn vào thực tiễn tổ chức và hoạt động của bộ máy nhà nước. Để góp phần làm sáng tỏ về phương diện lý luận nguyên tắc hiến định nói trên, trong bài viết này, xin bàn về hai vấn đề:
- Một là: Quan niệm về quyền lực nhà nước là thống nhất;
- Hai là: Tại sao phải có sự phân công giữa ba quyền lập pháp, hành pháp và tư pháp; ý nghĩa và nội dung của phân công, phối hợp ba quyền như thế nào?
1. Quan niệm về quyền lực nhà nước là thống nhất
Về vấn đề này, cho đến nay, trong nhận thức lý luận ở nước ta mới chỉ dừng lại ở quan niệm rằng, quyền lực nhà nước thuộc về một giai cấp hoặc liên minh giai cấp. Xét về bản chất giai cấp thì quyền lực nhà nước bao giờ cũng thống nhất trong tay giai cấp cầm quyền. ở nước ta, quyền lực nhà nước thuộc về giai cấp công nhân và nhân dân lao động dưới sự lãnh đạo của Đảng, về cơ bản lợi ích giữa các giai cấp là phù hợp với nhau. Vì vậy, quyền lực nhà nước là thống nhất, không phân chia. Nhấn mạnh tính thống nhất của quyền lực nhà nước là để khẳng định trong nhà nước ta không có sự phân chia quyền lực nhà nước; là để phủ nhận và đối lập với nguyên tắc phân quyền trong các nhà nước tư sản.Tuy nhiên, đây là vấn đề có tính lý luận và thực tiễn sâu sắc, cần phải đi sâu tìm hiểu và vận dụng nó một cách đầy đủ và nhất quán trong thực tiễn tổ chức và hoạt động của bộ máy nhà nước. Các khía cạnh của vấn đề về quyền lực nhà nước là thống nhất như: Thế nào là thống nhất quyền lực nhà nước? Quyền lực nhà nước thống nhất ở đâu? ý nghĩa của quyền lực nhà nước là thống nhất trong tổ chức và hoạt động của bộ máy nhà nước như thế nào? Các khía cạnh này đều cần được làm sáng tỏ về phương diện lý luận và nhận thức. Hiện nay, đang có các nhận thức khác nhau trên các khía cạnh này.- Có một số người cho rằng, quyền lực nhà nước là thống nhất, nhưng sự thống nhất đó tập trung vào Quốc hội. Bởi vì nhân dân là chủ thể của quyền lực nhà nước, nhưng lại không thực hiện được quyền lực nhà nước một cách trực tiếp, nên đã trao quyền cho cơ quan đại diện cao nhất do mình bầu ra là Quốc hội. Do vậy, Quốc hội được Hiến pháp xác nhận là cơ quan quyền lực nhà nước cao nhất. Và, với vị trí pháp lý đó, những người này đã ngộ nhận rằng Quốc hội là cơ quan có toàn quyền, là cơ quan cấp trên của các quyền hành pháp và tư pháp. Thật ra, đây là quan điểm tập quyền đã trở thành nguyên tắc tổ chức quyền lực nhà nước trong nền kinh tế kế hoạch hóa tập trung quan liêu bao cấp, mà thể hiện rõ nét nhất trong các quy định của Hiến pháp năm 1980. Nguyên tắc này có ưu điểm là bảo đảm cho quyền lực nhà nước tập trung, quyết định và thực thi quyền lực nhanh chóng, thống nhất. Tuy nhiên, nguyên tắc này cũng bộc lộ nhiều hạn chế. Đó là thiếu sự phân định phạm vi quyền lực nhà nước giữa các quyền lập pháp, hành pháp và tư pháp, thiếu sự kiểm soát quyền lực nhà nước giữa các cơ quan nhà nước, nhất là thiếu sự kiểm soát quyền lực nhà nước đối với quyền lập pháp. Hơn nữa, nguyên tắc này phủ nhận tính độc lập tương đối giữa các quyền nên đã hạn chế tính năng động, hiệu quả và trách nhiệm của mỗi quyền. Nhân dân và xã hội không có cơ sở để đánh giá chất lượng hoạt động của quyền lực nhà nước. Do vậy, trong điều kiện xây dựng nhà nước pháp quyền XHCN, tập quyền tiềm ẩn nguy cơ lạm dụng quyền lực nhà nước từ phía các cơ quan nhà nước được nhân dân trao quyền. - Một số khác lại cho rằng, trong nhà nước kiểu mới như nhà nước ta, giai cấp công nhân và nhân dân lao động dưới sự lãnh đạo của một đảng, ngày càng thống nhất về lợi ích, trong nội bộ không có sự phân chia thành phe phái đối lập như trong nhà nước tư sản, nên thống nhất quyền lực nhà nước là yếu tố duy nhất giữ vai trò quyết định trong tổ chức và hoạt động của bộ máy nhà nước. Quan niệm này đề cao tính thống nhất của quyền lực nhà nước, phủ nhận, xem thường hoặc hạ thấp vai trò của phân công, phân nhiệm rành mạch quyền lực nhà nước. Thực chất quan niệm này cũng không khác gì quan điểm nói trên. Hậu quả của nó cũng là thủ tiêu trách nhiệm trong lao động quyền lực nhà nước, hạ thấp vai trò của dân chủ và vô hiệu hóa chức năng giám sát của nhân dân đối với quyền lực nhà nước, là mảnh đất màu mỡ cho lạm dụng quyền lực nhà nước của nhân dân.
- Quan niệm đúng đắn hơn cả là quyền lực nhà nước thống nhất nơi nhân dân. Tất cả quyền lực nhà nước thuộc về nhân dân. Nhân dân là chủ thể tối cao của quyền lực nhà nước. Nhân dân trao quyền lực nhà nước của mình cho Quốc hội, cho Chính phủ và cho các cơ quan tư pháp. Chứ không phải nhân dân trao hết thảy quyền lực nhà nước của mình cho Quốc hội, rồi đến lượt mình, Quốc hội lại trao quyền cho Chính phủ và các cơ quan tư pháp. Theo Điều 84 của Hiến pháp năm 1992, nhân dân chỉ trao cho Quốc hội ba nhóm quyền hạn và nhiệm vụ: quyền hạn và nhiệm vụ về lập hiến, lập pháp; quyền hạn và nhiệm vụ về giám sát tối cao; quyền hạn và nhiệm vụ về quyết định các vấn đề quan trọng của đất nước. Quan niệm đó hoàn toàn phù hợp với dân chủ XHCN. Bởi vì, dân chủ XHCN đòi hỏi nhân dân thực hiện quyền lực nhà nước không chỉ bằng hình thức dân chủ đại diện mà còn bằng cả dân chủ trực tiếp, trong đó có trưng cầu ý dân, có như vậy, nguyên tắc tất cả quyền lực nhà nước thuộc về nhân dân mới đúng, mới bảo đảm thực hiện đầy đủ, không hình thức. Như vậy, thống nhất quyền lực nhà nước được hiểu là toàn bộ quyền lực nhà nước thuộc về nhân dân, tập trung thống nhất ở nhân dân chứ không phải thuộc về Quốc hội. Quan niệm đó có ý nghĩa lý luận và thực tiễn thiết thực. Trước hết, điều đó chỉ ra rằng, quyền lực nhà nước dẫu là quyền lập pháp, hành pháp hay tư pháp đều có chung một nguồn gốc thống nhất là nhân dân, đều do nhân dân ủy quyền, giao quyền. Do vậy, nói quyền lực nhà nước là thống nhất trước tiên là sự thống nhất ở mục tiêu chính trị, nội dung chính trị của nhà nước. Cả ba quyền lập pháp, hành pháp và tư pháp tuy có chức năng, nhiệm vụ và quyền hạn khác nhau nhưng đều thống nhất với nhau ở mục tiêu chính trị chung là xây dựng một nhà nước "dân giàu, nước mạnh, xã hội công bằng, dân chủ, văn minh" như Đảng ta đã chỉ ra.
Quan niệm quyền lực nhà nước là thống nhất như nói trên là cách thức tổ chức quyền lực nhà nước đề cao trách nhiệm trước nhân dân, hạn chế sự dựa dẫm, ỷ lại trong việc thực hiện quyền hạn và nhiệm vụ mà nhân dân đã ủy quyền. Đó cũng là cơ sở để không có chỗ cho các yếu tố cực đoan, đối lập, thiếu trách nhiệm trong mối quan hệ giữa các quyền, nhất là giữa quyền lập pháp và quyền hành pháp. Đồng thời, đó cũng là điều kiện để hình thành cơ chế kiểm soát, nhận xét, đánh giá chất lượng và hiệu quả hoạt động của các quyền từ bên trong tổ chức quyền lực nhà nước cũng như từ bên ngoài là nhân dân.Tóm lại, quan niệm quyền lực nhà nước là thống nhất và tập trung ở nhân dân, chủ thể tối cao và duy nhất của quyền lực nhà nước là quan niệm đúng, có ý nghĩa chỉ đạo tổ chức quyền lực nhà nước trong điều kiện xây dựng nhà nước pháp quyền XHCN của dân, do dân và vì dân. Mọi biểu hiện xa rời quan điểm quyền lực nhà nước thuộc về nhân dân đều dẫn đến tổ chức quyền lực nhà nước kém hiệu quả.2. Quan niệm về phân công, phối hợp giữa ba quyền lập pháp, hành pháp và tư phápNhư đã nói ở phần trên, trong chế độ dân chủ và pháp quyền thì quyền lực nhà nước không phải là quyền lực tự có của nhà nước mà quyền lực được nhân dân ủy quyền, nhân dân giao quyền. Vì quyền lực nhà nước là của nhân dân, nhưng nhân dân lại không trực tiếp thực hiện quyền lực nhà nước của mình mà lại giao cho người khác là nhà nước, nên tất yếu nảy sinh đòi hỏi chính đáng và tự nhiên phải kiểm soát quyền lực nhà nước. Mặt khác, khi ủy quyền cho nhà nước, quyền lực nhà nước lại thường vận động theo xu hướng tự phủ định mình, trở thành đối lập với chính mình lúc ban đầu (từ của nhân dân là số đông chuyển thành số ít của một nhóm người hoặc của một người). C.Mác gọi hiện tượng này là sự tha hóa của quyền lực nhà nước. Quyền lực nhà nước là của nhân dân giao cho các cơ quan nhà nước, suy cho cùng, là giao cho những con người cụ thể thực thi. Mà con người thì "luôn luôn chịu sự ảnh hưởng của các loại tình cảm và dục vọng đối với các hành động của con người. Điều cũng khiến cho lý tính đôi khi bị chìm khuất" (3). Đặc biệt là khi lý tính bị chi phối bởi các dục vọng, thói quen hay tình cảm thì khả năng sai lầm trọng việc thực thi quyền lực nhà nước càng lớn. Hơn nữa, với bản tính vị kỷ, con người thường "bị điều khiển bởi khát vọng, trong đó khát vọng về quyền lực vừa là mục tiêu, vừa là công cụ để đạt các khát vọng khác" (4). Với đặc điểm đó của con người, không thể khẳng định người được ủy quyền luôn luôn làm đúng, làm đủ những gì mà nhân dân đã ủy quyền. Vì vậy, kiểm soát quyền lực nhà nước là một nhu cầu khách quan từ phía người ủy quyền đối với người được ủy quyền. Hơn thế nữa, quyền lực nhà nước không phải là một đại lượng có thể cân, đong, đo, đếm được một cách rạch ròi, vì nó là một thể thống nhất, như nói ở phần trên. Điều đó lại càng đòi hỏi phải kiểm soát quyền lực nhà nước để hạn chế sự lộng quyền, lạm quyền, mâu thuẫn chồng chéo hoặc trùng lắp trong quá trình thực thi quyền lực nhà nước giữa các cơ quan nhà nước, hạn chế hiệu lực và hiệu quả thực thi quyền lực nhà nước được nhân dân ủy quyền.
Xuất phát từ các đòi hỏi khách quan nói trên, quyền lực nhà nước thường được lượng hóa, phân định thành các quyền lập pháp, hành pháp và tư pháp. Sự lượng hóa này là để giao cho các cơ quan nhà nước khác nhau, thay mặt nhân dân thực hiện. Trong thực tiễn ở nước ta, cũng như các nước, quyền lập pháp được giao cho Quốc hội hay Nghị viện, quyền hành pháp được giao Chính phủ, quyền tư pháp được giao cho Tòa án. Sự phân định các quyền như vậy là điều kiện cơ bản để nhân dân giao quyền mà không bị lạm quyền, nhân dân kiểm soát và đánh giá được hiệu lực và hiệu quả thực hiện các quyền mà mình đã giao. Đồng thời, cũng là để cho các cơ quan tương ứng được giao quyền đề cao trách nhiệm trong việc thực thi quyền lực nhà nước và tự kiểm tra việc thực hiện quyền lực nhà nước được giao của mình.Quyền lập pháp là quyền đại diện cho nhân dân thể hiện ý chí chung của quốc gia. Những người được nhân dân trao cho quyền này là những người do phổ thông đầu phiếu bầu ra hợp thành cơ quan gọi là Quốc hội hay Nghị viện. Thuộc tính cơ bản, xuyên suốt mọi hoạt động của quyền này là đại diện cho nhân dân, bảo đảm cho ý chí chung của nhân dân và được thể hiện trong các đạo luật mà mình là cơ quan duy nhất được nhân dân giao quyền biểu quyết thông qua luật. Quyền biểu quyết thông qua luật là quyền lập pháp, chứ không phải là quyền đưa ra các mô hình xử sự cho xã hội. Vì vậy, quyền lập pháp không đồng nghĩa với quyền làm ra luật. Đồng thời, là người thay mặt nhân dân giám sát tối cao mọi hoạt động của nhà nước, nhất là hoạt động thực hiện quyền hành pháp, để góp phần giúp cho các quyền mà nhân dân giao cho các cơ quan nhà nước không bị lạm quyền, lộng quyền hay bị tha hóa.Quyền hành pháp là quyền tổ chức thực hiện ý chí chung của quốc gia do Chính phủ đảm trách. Thuộc tính cơ bản, xuyên suốt mọi hoạt động của quyền này là quản lý nhà nước (hay cai trị) mà thực chất là tổ chức thực hiện pháp luật để bảo đảm an ninh, an toàn và phát triển xã hội. Không có một Chính phủ quản lý nhà nước hữu hiệu không thể có một nhà nước giàu có, phát triển ổn định cả về mặt kinh tế lẫn mặt xã hội. Thực hiện quyền này đòi hỏi Chính phủ và các thành viên của Chính phủ phải nhanh nhạy, quyết đoán kịp thời và quyền uy tập trung thống nhất.
Quyền tư pháp là quyền xét xử, được nhân dân giao cho tòa án. Độc lập và chỉ tuân theo pháp luật là nguyên tắc xuyên suốt và cao nhất trong tổ chức thực hiện quyền này, mọi cá nhân, cơ quan, tổ chức không được phép can thiệp vào hoạt động xét xử của Tòa án. Đây thực chất là quyền bảo vệ ý chí chung của quốc gia bằng việc xét xử các hành vi vi phạm Hiến pháp, pháp luật từ phía công dân và cơ quan nhà nước. Vì vậy, bảo vệ pháp luật, công lý, tự do của công dân là trách nhiệm hàng đầu của quyền tư pháp. Mọi cơ quan, tổ chức và cá nhân có nghĩa vụ tôn trọng, giữ gìn và bảo vệ tính pháp quyền và công lý trong các phán quyết của Tòa án.
Như vậy, xuất phát từ đặc điểm của quyền lực nhà nước, việc phân định thành ba quyền nói trên là một nhu cầu khách quan. Ngày nay, xu hướng phân định rành mạch ba quyền đó ngày càng được coi trọng trong tổ chức quyền lực nhà nước. Bởi vì, xã hội càng phát triển, phân công lao động càng phải chuyên môn hóa cao để phát huy hiệu quả. Đồng thời, thực tiễn xây dựng nhà nước pháp quyền XHCN ở nước ta chỉ ra rằng, việc phân định rành mạch ba quyền là cách thức tốt nhất để phát huy vai trò của nhà nước trong công cuộc xây dựng và phát triển đất nước.
Tuy nhiên, như đã nói ở trên, trong nhà nước ta quyền lực nhà nước là thống nhất. Đó là sự thống nhất về mục tiêu chính trị chung. Vì vậy, việc phân định quyền lực nhà nước không chứa đựng và bao quát cả việc phân lập mục tiêu chính trị chung của quyền lực nhà nước. Do vậy, mặc dù có sự phân định ba quyền nhưng cả ba quyền lập pháp, hành pháp và tư pháp không hoàn toàn tách biệt nhau mà "ràng buộc lẫn nhau", phối hợp với nhau, hoạt động một cách nhịp nhàng trên cơ sở làm đúng, làm đủ nhiệm vụ. quyền hạn mà nhân dân giao cho mỗi quyền được Hiến pháp - đạo luật gốc của nhà nước và xã hội quy định. Mục đích của việc phân công quyền lực nhà nước là để nhằm kiểm soát quyền lực nhà nước, bảo đảm cho tính pháp quyền của nhà nước và phát huy dân chủ XHCN, chứ không phải là để thỏa hiệp hay chia rẽ quyền lực nhà nước giữa các quyền. ý nghĩa của sự phân công quyền lực nhà nước là để phân định nhiệm vụ và quyền hạn của các cơ quan trọng bộ máy nhà nước, để nhà nước hoạt động có hiệu lực và hiệu quả, quyền lực nhà nước ngày càng thực sự là quyền lực của nhân dân.Tóm lại, quyền lực nhà nước là thống nhất, có sự phân công và phối hợp giữa các cơ quan nhà nước trong việc thực hiện các quyền lập pháp, hành pháp, tư pháp là nguyên tắc tổ chức và hoạt động của bộ máy nhà nước ta, đã được thực tiễn kiểm nghiệm đúng đắn. Nghĩ rằng, nguyên tắc này cần được bổ sung và khẳng định trong Cương lĩnh của Đảng ta trong thời gian tới. Tuy nhiên, để nhấn mạnh và làm rõ hơn vai trò của kiểm soát quyền lực nhà nước từ phía nhân dân và từ bên trong của chính bản thân quyền lực nhà nước, cần bổ sung thêm cụm từ "kiểm soát" vào nội dung của nguyên tắc - Nguyên tắc trên viết thành: "Quyền lực nhà nước là thống nhất, có sự phân công, phối hợp và "kiểm soát" giữa các cơ quan nhà nước trong việc thực hiện các quyền lập pháp, hành pháp, tư pháp".

Tìm hiểu Hiến pháp CHDCND Triều Tiên

LỜI NÓI ĐẦU
Trong giai đoạn hiện nay khi mà toàn cầu hóa đang là một xu thế của các quốc gia trên thế giới, thì Cộng hòa dân chủ nhân dân Triều Tiên dường như vẫn cách biệt với phần còn lại của thế giới. Nhà nước, pháp luật của Cộng hòa dân chủ nhân dân Triều Tiên cũng vậy nó vẫn còn quá xa lạ với chúng ta; nhằm mục đích giúp sinh viên khi nghiên cứu và học tập môn Luật Nhà nước có được những nắm bắt cơ bản về tổ chức bộ máy nhà nước cũng như các nguyên tắc hoạt động cơ bản của quốc gia tương đối đặc biệt này (một trong bốn quốc gia vẫn kiên định con đường đi lên xây dựng Chủ nghĩa xã hội), chúng tôi tiến hành sưu tầm và biên soạn tài liệu tìm hiểu về Hiến pháp Cộng hòa dân chủ nhân dân Triều Tiên và giới thiệu nó tới tất cả các bạn sinh viên cũng như những ai quan tâm tới vấn đề Hiến pháp nói chung và Hiến pháp xã hội chủ nghĩa nói riêng. Tuy nhiên trong quá trình biên soạn tài liệu này do chưa có bản dịch tiếng Việt nên có thể có một số câu từ chúng tôi biên tập có thể chưa đúng hoặc sát nghĩa. Nhằm mục đích để bạn đọc có sự kiểm chứng và đánh giá, trong phần phụ lục chúng tôi xin gửi tới bạn đọc bản Hiến pháp Cộng hòa dân chủ nhân dân Triều Tiên nguyên bản bằng tiếng Anh và rất mong được sự phản hồi của bạn đọc. Hiến pháp Cộng hòa dân chủ nhân dân Triều Tiên được ban hành ngày 09/05/1998. Gồm có lời nói đầu 7 chương và 166 điều.
Chương 1: Chính trị bao gồm 18 điều từ điều 1 đến điều 18
Chương 2: Kinh tế bao gồm 20 điều từ điều 19 đến điều 38
Chương 3: Văn hóa bao gồm 19 điều từ điều 39 đến điều 57
Chương 4: Quốc phòng bao gồm 4 điều từ điều 58 đến điều 61
Chương 5: Quyền và nghĩa vụ công dân bao gồm 25 điều từ điều 62 đến điều 86
Chương 6: Bộ máy nhà nước bao gồm 100 điều từ điều 63 đến điều 162. (được chia thành 7 phần)
Chương 7: Quốc kỳ - Quốc ca – Thủ đô bao gồm 4 điều từ điều 163 đến 166

Ngay trong lời của Hiến pháp đã xác định Cộng hòa dân chủ nhân dân Triều Tiên là một nước Xã hội chủ nghĩa, được xây dựng trên nền tảng hệ tư tưởng của lãnh tụ vĩ đại Kim Nhật Thành (Kim Sung Il) người đã lãnh đạo nhân dân Triều Tiên giành độc lập từ tay phát xít Nhật. Lãnh tụ Kim Nhật Thành được coi là “ Chủ tịch vĩnh cửu” của Cộng hòa dân dân nhân dân Triều Tiên;
Lời nói đầu của Hiến pháp cũng xác định rõ vai trò của Cộng hòa dân chủ nhân dân Trều tiên trên thế giới cũng như những điểm cơ bản nhất về chính sác đối ngoại của mình.
Chương 1. Chính trị(Politics)
Trong chương này ngay tại điều 1 đã xác định Cộng hòa dân chủ nhân dân Triều Tiên là một quốc gia độc lập và là đại diện cho quyền lợi của tất cả các dân tộc sinh sống trên đất nước; Hiến pháp cũng xác định con người là trung tâm của thế giới (điều 3) cũng như xác định chủ quyền đất nước thuộc về các giai cấp công nhân, nông dân, trí thức cũng như của toàn thể nhân dân lao động (điều 4); Hiến pháp Cộng hòa dân chủ nhân dân Triều Tiên cũng xác định nguyên tắc tổ chức và hoạt động cơ bản của bộ máy nhà nước đó là nguyên tắc tập trung dân chủ (điều 5), cũng như xác định cách thức thành lập ra các cơ quan trong bộ máy Nhà nước và nguyên tắc bầu cử được áp dụng đó là phổ thông, bình đẳng , trực tiếp và bỏ phiếu kín (điều 6).
Hiến pháp Cộng hòa dân chủ nhân dân Triều Tiên cũng như Hiến pháp của Việt Nam mặc dù xác định quyền lực Nhà nước là thuộc về nhân dân những vẫn khẳng định vai trò lãnh đạo của giai cấp tiên tiến nhất đó là giai cấp công nhân và điều này đã được ghi nhận tại điều 10 của Hiến pháp; điều 11 của Hiến pháp này cũng xác định rõ vai trò lãnh đạo của Đảng công nhân Triều Tiên. Cộng hòa dân chủ nhân dân Triều Tiên cũng khẳng định sẽ dùng mọi biện pháp và sức mạnh của mình để thúc đẩy công cuộc xây dựng chủ nghĩa xã hội tại Bắc Triều Tiên (điều 14)
Cộng hòa dân chủ nhân dân Triều Tiên cam kết mạnh mẽ về đường lối đối ngoại rộng mở của mình cũng như bảo vệ các quyền và lợi ích hợp pháp của công dân nước ngoài trên toàn bộ lãnh thổ Triều Tiên (điều 16)….
Chương 2. Kinh tế (Economy)
Ngay điều đầu tiên của chương này Hiến pháp đã xác định kinh tế của Cộng hòa dân chủ nhân dân Triều Tiên là một nền kinh tế xã hội chủ nghĩa và độc lập tự chủ (điều 19); Hiến pháp Triều Tiên cũng khẳng định tất cả các tư liệu sản xuất đều thuộc sở hữu nhà nước và sở hữu tập thể (điều 20,21,22); Triều Tiên thừa nhận quyền sở hữu tư nhân đối với các bất động sản nhỏ phục vụ cho cuộc sống riêng tư của công dân (điều 24). Triều Tiên thừa nhận quyền sở hữu tài sản từ các thu nhập hợp pháp của công dân và kinh tế hộ gia đình của công dân. Hiến pháp Triều Tiên khẳng định Nhà nước sẽ cung cấp tất cả các nhu cầu cho người lao động một cách hoàn toàn miễn phí như thực phẩm, lương thực, nhà ở và các dịch vụ y tế (điều 25, 26).
Tại các điều 27,28 và 29 Hiến pháp Cộng hòa dân chủ nhân dân Triều Tiên khẳng định yếu tố then chốt thúc đẩy kinh tế của Triều Tiên tiến lên đó chính là khoa học kỹ thuật; Hiến pháp quy định thời gian làm việc một ngày là 8 giờ và độ tuổi để tham gia lao động là từ 16 tuổi. Điều 34 của Hiến pháp khẳng định nền kinh tế của Cộng hòa dân chủ nhân dân Triều Tiên là một nền kinh tế kế hoạch và cũng như quy định tại Hiến pháp của chúng ta năm 1980, Hiến pháp hiện hành của Cộng hòa dân chủ nhân dân Triều Tiên khẳng định nhà nước hoàn toàn độc quyền về ngoại thương; các hoạt động liên doanh, liên kết cũng như đầu tư nước ngoài tại Cộng hòa dân chủ nhân dân Triều Tiên chỉ được tiến hành trong phạm vi một số khu kinh tế đặc biệt[1] (điều 34,36,37)
Chương 3. Văn hóa (Culture)
Trong lĩnh vực văn hóa – xã hội cũng như giáo dục Hiến pháp Cộng hòa dân chủ nhân dân Triều Tiên xác định sẽ thực hiện một cuộc cách mạng văn hóa để đào tạo những con người có đủ khả năng xây dựng thành công chủ nghĩa xã hội cũng như chủ nghĩa cộng sản tại Triều Tiên (điều 40); Hiến pháp cũng xác định chiến lược của giáo dục đào tạo được áp dụng tại Cộng hòa dân chủ nhân dân Triều Tiên là đào tạo ra nguồn lực cho đất nước cũng như xác định hai nguyên lý cơ bản để phát triển giáo dục đó là gắn liên hoạt động giáo dục với lao động sản xuất và khẳng định nền giáo dục là một nền giáo dục hiện đại (điều 45); Tại điều 47 Hiến pháp cũng khẳng định tất cả các công dân của Cộng hòa dân chủ nhân dân Triều Tiên đều được hưởng một nền giáo dục hoàn toàn miễn phí ở tất cả các bậc học, không những vậy đối với học sinh và sinh viên học tập tại các trường đại học và cao đẳng còn được hưởng chính sách phụ cấp từ nhà nước. Hiến pháp Cộng hòa dân chủ nhân dân Triều Tiên cũng khẳng định tất cả trẻ em ở độ tuổi mẫu giáo đều phải bắt buộc đến trường và nhà nước cũng đài thọ hoàn toàn mọi chi phí cho học sinh ở cấp học này (điều 49). Tại điều 56 của Hiến pháp cũng khẳng định nhà nước duy trì hệ thống dịch vụ y tế hoàn toàn miễn phí và nhà nước có trách nhiệm đào tạo một đội ngũ bác sỹ cũng như những nhân viên y tế đủ mạnh để đảm bảo việc chăm lo đời sống sức khỏe cho nhân dân. Nhìn chung trong chương chế độ văn hóa – xã hội và giáo dục này Hiến pháp cộng hòa dân chủ nhân dân Triều Tiên đặc biệt nhấn mạnh hệ tư tưởng "Joo-cheh" (con người là chủ của tất cả mọi thứ và quyết định tất cả mọi thứ), vì vậy có thể nói xuyên suốt trong tất cả các chương điều của Hiến pháp nói chung và của chương thứ 3 nói riêng thì yếu tố con người luôn được đặc biệt quan tâm.
Chương 4. Bảo vệ tổ quốc (National Defense)
Ngay tại điều đầu tiên của chương (điều 58), Hiến pháp xác định quốc phòng là sự nghiệp của toàn dân; và nhiệm vụ của các lực lượng vũ trang Triều Tiên là bảo vệ nhà nước; bảo vệ chế độ xã hội chủ nghĩa, bảo vệ các lợi ích của nhân dân (điều 60). Nhà nước thực hiện chính sách không ngừng hiện đại hóa quốc phòng cũng như tăng cường tính kỷ luật trong quân đội (điều 61).
Chương 5. Quyền và nghĩa vụ của công dân (Fundamental Rights and Duties of Citizens)
Hiến pháp cộng hòa dân chủ nhân dân Triều Tiên khẳng định công dân Cộng hòa dân chủ nhân dân Triều Tiên sẽ được bảo vệ ở tất cả mọi nơi trên thế giới (điều 61), và các quyền và nghĩa vụ cụ thể của từng công dân được xây dựng và xác định dựa trên cơ sở quyền lợi chung của cả cộng đồng và xã hội theo đúng nguyên tắc một người vì mọi người, mọi người vì một người (điều 62). Hiến pháp Cộng hòa dân chủ nhân dân Triều Tiên cũng khẳng định tất cả mọi công dân đều bình đẳng và nhà nước không thừa nhận sự phân biệt đối xử đối với bất cứ thành phần dân cư nào; các quyền tự do và dân chủ luôn được nhà nước bảo đảm và khuyến khích (điều 64,65). Hiến pháp tại điều 66 xác định độ tuổi để công dân có thể thực thiện quyền chính trị cơ bản của mình (quyền bầu cử) là 17 và cũng như Hiến pháp Việt Nam thì vấn đề dân tộc, tôn giáo cũng như trình độ… không được coi là yếu tố ảnh hưởng đến quyền chính trị cơ bản này; việc hạn chế quyền bầu cử của công dân chỉ có thể được thực hiện bởi một quyết định của cơ quan Tòa án.
Một trong những quyền rất quan trọng của công dân đó là quyền tự do báo chí, ngôn luận cũng như lập hội cũng được nhà nước thừa nhận và bảo hộ tại điều 67 của Hiến pháp. Hiến pháp Triều Tiên cũng xác định quyền tự do tín ngưỡng, tôn giáo của công dân tuy nhiên các hoạt động tôn giáo chỉ được coi là hợp pháp nếu nó có được sự chấp thuận từ phía nhà nước; không ai được phép lợi dụng tôn giáo như là một lý do để làm ảnh hưởng đến các hoạt động bình thường của nhà nước và xã hội (điều 68); quyền khiếu nại và tố cáo của công dân cũng là một quyền quan trọng và nó được nhà nước bảo vệ, Hiến pháp cũng quy định vấn đề giải quyết các khiếu nại cũng như tố cáo của công dân phải được tiến hành một cách nhanh chóng và theo đúng các quy định của pháp luật (điều 69).
Công dân có quyền có việc làm, có quyền tự quyết định để lựa chọn cho mình một nghề nghiệp phù hợp với trình độ và khả năng của mình, nhà nước có trách nhiệm cung cấp cho công dân một việc làm ổn định với những điều kiện làm việc hợp lý, nhà nước có chế độ đãi ngộ đối với công sức mà công dân đã bỏ ra theo đúng những thành quả lao động của mình (điều 70). Công dân ngoài thời gian làm việc thì có quyền nghỉ ngơi để phục hồi khả năng lao động vì vậy nên Hiến pháp quy định rõ quyền của công dân được nghỉ trong các ngày lễ cũng như chế độ nghỉ dưỡng tại các cơ sở của nhà nước (điều 71); Hiến pháp Cộng hòa dân chủ nhân dân Triều Tiên cũng khẳng định quyền được chăm sóc sức khỏe của công dân tại điều 71 bằng những quy định công dân có quyền được thụ hưởng miễn phí tất cả các dịnh vụ y tế; người tàn tật, người già và trẻ em được nhà nước chăm sóc; điều 71 cũng khẳng định nhà nước sẽ tập trung chăm lo đến hệ thống an sinh xã hội, tập trung đầu tư cho các bệnh viện và các trường học vì vậy tại điều 72 khẳng định công dân có quyền được học tập tại tất cả các nhà trường mà không phải trả bất kỳ một khoản chi phí nào. Hiến pháp cũng khẳng định bảo hộ quyền nghiên cứu và sáng chế của công dân bằng cách bảo vệ triệt để vấn đề tác giả trên các lĩnh vực.
Hiến pháp Cộng hòa dân chủ nhân dân Triều Tiên cũng đã ghi nhận quyền tự do đi lại và cư trú của công dân tại bất cứ đâu trên lãnh thổ tại điều 75. Vấn đề nhân đạo cũng được Hiến pháp đề cập tới như là một trong những vấn đề cơ bản và quan trọng, thể hiện được bản chất tốt đẹp của nhà nước qua quy định tại điều 76 với quy định nhà nước sẽ tạo những điều kiện tốt nhất cho những người có công với nước cũng như gia đình các thương binh, liệt sỹ và người tàn tật.
Vấn đề bình đẳng nam nữ cũng được Hiến pháp đề cập tại điều 77 Hiến pháp bằng quy định phụ nữ có quyền bình đẳng với nam giới về các lĩnh vực trong đời sống chính trị xã hội; nhà nước cũng khẳng định vấn đề hôn nhân và gia đình được bảo hộ bằng quy định tại điều 78 của Hiến pháp.
Công dân được nhà nước bảo đảm quyền bất khả xâm phạm về tính mạng, không ai có thể bị bắt nếu pháp luật không cho phép (điều 79); và cũng như các bản Hiến pháp xã hội chủ nghĩa, Hiến pháp Cộng hòa dân chủ nhân dân Triều Tiên quy định quyền cư trú chính trị đối với những người nước ngoài đấu tranh cho hòa bình, dân chủ, độc lập dân tộc, chủ nghĩa xã hội cũng như là sự tiến bộ của khoa học… mà bị bức hại thì sẽ được xem xét việc cho cư trú.
Chương 6. Bộ máy Nhà nước (The Structure of the State)
Phần 1: Quốc Hội (The Supreme People 's Assembly )
Ngay tại điều 87(điều đầu tiên của chương thứ 6) đã khẳng định cơ quan quyền lực nhà nước cao nhất của Cộng hòa dân chủ nhân dân Triều Tiên chính là Quốc hội Triều Tiên; và Quốc hội Triều Tiên là cơ quan có quyền lập pháp, tuy nhiên không giống như quy định của Hiến pháp Việt Nam chỉ dành riêng quyền lập pháp cho một mình Quốc hội (Quốc hội là cơ quan duy nhất có quyền lập hiến, lập pháp), Hiến pháp Triều Tiên tại điều 88 quy định trong thời gian Quốc hội không họp thì Đoàn chủ tịch của Quốc hội[2] cũng có quyền lập pháp. Cũng như đa phần các Quốc hội khác trên thế giới, Quốc hội Cộng hòa dân chủ nhân dân Triều Tiên cũng được cử tri cả nước bầu ra theo 4 nguyên tắc đó là phổ thông – bình đẳng – trực tiếp và bỏ phiếu kín (điều 89); nhiệm kỳ của Quốc hội theo quy địnhcủa Hiến pháp là 5 năm ( Quốc hội hiện nay của Cộng hòa dân chủ nhân dân Triều Tiên là Quốc hội khóa 13 ; Nhiệm kỳ 2009 – 2114), tuy nhiên nhiệm kỳ của Quốc hội cũng có thể được rút ngắn hay kéo dài tùy thuộc vào quyết định Đoàn chủ tịch Quốc hội (điều 90). Theo quy định của Hiến pháp Cộng hòa dân chủ nhân dân Triều Tiên tài điều 91, thì Quốc hội có những nhiệm vụ quyền hạn như: Sửa đổi bổ sung Hiến pháp, Luật; quyết định các nguyên tắc cơ bản trong tổ chức và hoạt động của bộ máy nhà nước; bầu chủ tịch Hội đồng quốc phòng[3]; bầu Thủ tướng Chính phủ; bầu Chánh án Tòa án nhân dân tối cao; quyết định việc phê chuẩn hoặc bãi bỏ các điều ước Quốc tế….
Quốc hội Cộng hòa dân chủ nhân dân Triều Tiên họp thường kỳ 2 lần 1 năm, ngoài ra cũng có thể triệu tập kỳ họp bất thường nếu khi có yêu cầu từ phía 1/3 tổng số đại biểu hoặc từ phía đoàn chủ tịch[4] (điều 92).
Hiến pháp Cộng hòa dân chủ nhân dân Triều Tiên cũng khẳng định các đạo luật chỉ thực sự được thông qua với sự đồng thuận của hơn ½ tổng số đại biểu Quốc hội và tỷ lệ đó là 2/3 đối với Hiến pháp (điều 97); để giúp việc cho Quốc hội, Quốc hội Cộng hòa dân chủ nhân dân Triều Tiên thành lập ra các cơ quan chuyên môn như Ủy ban pháp luật; Ủy ban ngân sách…, thành phần của các Ủy ban này gồm có Chủ tịch, các Phó chủ tịch và các thành viên (điều 98). Điều 99 của Hiến pháp quy định các bảo đảm dành cho Đại biểu Quốc hội như quyền bất khả xâm phạm về thân thể, Hiến pháp quy định rõ không thể bắt đại biểu Quốc hội nếu không có sự đồng ý của Quốc hội và trong thời gian Quốc hội không họp thì chỉ được phép bắt Đại biểu khi có sự đồng ý của Đoàn chủ tịch Quốc hội trừ trường hợp phạm tội quả tang (flagrant offence)
Phần 2: Hội đồng Quốc phòng[5] (The National Defense Commission)
Hội đồng quốc phòng là cơ quan lãnh đạo quân sự cao nhất của Cộng hòa dân chủ nhân dân Triều Tiên; Thành phần của Hội đồng Quốc phòng gồm có Chủ tịch, Phó chủ tịch thứ nhất, Phó chủ tịch và các thành viên; Chủ tịch Hội đồng Quốc phòng đồng thời là tổng chỉ huy các lực lượng vũ trang của đất nước (điều 100,101,102).
Quyền hạn của hội đồng Quốc phòng được quy định tại điều 103 của Hiến pháp, bao gồm các nhiệm vụ như: Xây dựng và phát triển lực lượng vũ trang toàn quốc; thành lập hoặc giải tán các cơ sở đào tạo Quốc phòng; bổ nhiệm cũng như cách chức các tướng lĩnh trong quân đội… (điều 103)
Phần 3: Đoàn chủ tịch Quốc hội[6] (The SPA Presidium)
Hiến pháp xác định Đoàn chủ tịch là cơ quan quyền lực nhà nước cao nhất trong thời gian Quốc hội không họp; thành viên của Đoàn chủ tịch Quốc hội bao gồm: Chủ tịch, Phó chủ tịch, Tổng thư ký và các thành viên. Ngoài ra Đoàn chủ tịch Quốc hội có thể bổ nhiệm một số Phó chủ tịch danh dự, những người này có thể là đại biểu Quốc hội hoặc không phải là Đại biểu Quốc hội nhưng có sự đóng góp quan trọng vào công cuộc xây dựng và bảo vệ tổ quốc (điều 106,107,108).
Đoàn chủ tịch Quốc hội có những nhiệm vụ quyền hạn cụa thể được quy định tại điều 110 của Hiến pháp; cụ thể có 17 nhiệm vụ quyền hạn trong đó có những nhiệm vụ cơ bản như:
Triệu tập các phiên họp của Quốc hội;
Thẩm tra và phê duyệt các kế hoạch về phát triển kinh tế, xã hội của đất nước;
Giải thích Hiến pháp và pháp luật;
Bổ nhiệm thủ tướng chính phủ cũng như các Phó thủ tướng Chính phủ cũng như các Bộ trưởng;
Bầu các Thẩm phán của Tòa án nhân dân tối cao;
Quyết định các vấn đề mang tính đối ngoại của đất nước…
Chủ tịch Đoàn chủ tịch Quốc hội chủ trì phiên họp của Đoàn chủ tịch và cuộc họp được tiến hành bởi tất cả các thành viên của Đoàn chủ tịch như là Phó chủ tịch, thư ký và các thành viên (điều 112)
Phần 4: Chính phủ (Cabinet)
Chính phủ là cơ quan hành chính nhà nước cao nhất của cơ quan quyền lực nhà nước cao nhất[7]; và chức năng chủ yếu của Chính phủ là quản lý nhà nước nói chung (điều 117). Thành phần của Chính phủ gồm có : Thủ tướng Chính phủ, các Phó Thủ tướng, các Bộ trưởng và các thành viên khác (điều 118). Nhiệm vụ, quyền hạn của Chính phủ được quy định tại điều 119 gồm có các nhiệm vụ cơ bản như ban hành, sửa đổi bổ sung các quy định liên quan đến lĩnh vực quản lý nhà nước trên cơ sở Hiến pháp và pháp luật; thành lập cũng như giải tán một số cơ quan thuộc Chính phủ, các tổ chức kinh tế, các doanh nghiệp cũng như được phép áp dụng các biện pháp cần thiết để cải thiện cơ cấu kinh tế của đất nước; áp dụng các biện pháp để củng cố và phát triển hệ thống ngân hàng…
Thủ tướng chính phủ là người đại diện cho Chính phủ của Cộng hòa dân chủ nhân dân Triều Tiên, cũng như phải chịu trách nhiệm về hoạt động của chính phủ (điều 120)
Phần 5: Hội đồng địa phương (Local People's Assembly)
Cộng hòa dân chủ nhân dân Triều Tiên gồm hai thành phố trực thuộc quản lý trực tiếp của chính phủ,ba vùng đặc biệt với các chức năng khác nhau, và chín tỉnh[8]
Hiến pháp Cộng hòa dân chủ nhân dân Triều Tiên khẳng định Hội đồng địa phương được tổ chức ở tất cả các đơn vị hành chính của Triều Tiên và là cơ quan quyền lực nhà nước tối cao tại các địa phương; các đại biểu của Hội đồng nhân dân địa phương cũng được bầu theo 4 nguyên tắc đó là phổ thông, bình đẳng , trực tiếp và bỏ phiếu kín. Các hội đồng này có nhiệm kỳ là 4 năm (điều 131,132,133,134).
Hội đồng nhân dân địa phương có những nhiệm vụ và quyền hạn cơ bản như lên kế hoạch để triển khai các nhiệm vụ về phát triển kinh tế tại địa phương; tổ chức việc thực hiện thu cho ngân sách tại địa phương mình; bầu Chủ tịch, Phó chủ tịch của Ủy ban nhân dân cùng cấp[9]; tổ chức việc thực hiện và áp dụng pháp luật trên lãnh thổ mà mình quản lý; bầu các thẩm phán của Tòa án nhân dân địa phương cũng như Hội thẩm và hướng dẫn, kiểm tra hoạt động của Ủy ban cấp dưới (điều 134). Hội đồng địa phương họp định kỳ một năm từ một đến hai lần, ngoài ra nếu theo yêu cầu của tối thiểu 1/3 đại biểu thì cũng có thể triệu tập kỳ họp bất thường (điều 135).
Phần 6: Ủy ban nhân dân địa phương (Local People's Committee)
Điều 139 của Hiến pháp quy định, tương ứng với cách thức tổ chức Hội đồng nhân dân ở các địa phương, thì Ủy ban nhân dân cũng được tổ chức một cách tương ứng; thành phần Ủy ban nhân dân gồm có Chủ tịch Ủy ban nhân dân, các Phó chủ tịch Ủy ban nhân dân, Thư ký và các thành viên Ủy ban; Nhiệm kỳ của ủy ban nhân dân bằng với nhiệm kỳ của Hội đồng địa phương (điều 140).
Ủy ban nhân dân có các nhiệm vụ, quyền hạn được quy định tại điều 141 của Hiến pháp; bao gồm một số nhiệm vụ cơ bản như: Chuẩn bị cho công tác bầu cử tại địa phương; tổ chức thực hiện pháp luật tại địa phương; thực hiện Nghị quyết của Hội đồng ; thực hiện chức năng quản lý nhà nước tại địa phương mình…
Hình thức hoạt động quan trọng nhất của Ủy ban là kỳ họp (điều 142), kỳ họp được tiến hành với tất cả thành viên của ủy ban dưới sự điều hành của Chủ tịch Ủy ban, các Phó Chủ tịch và thư ký. Các Ủy ban có thành lập một số Ủy ban không thường trực để giúp ủy ban thực hiện một số công việc cụ thể (điều 145)
Phần 7: Văn phòng công tố và Tòa án (the court and the public prosecutors office)
Điều 147 – Hiến pháp Cộng hòa dân chủ nhân dân Triều Tiên quy định về cơ cấu Tòa án bao gồm: Tòa án tối cao; tòa án cấp Tỉnh và tương đương; Tòa án cấp Huyện và tương đương và Tòa án đăc biệt. Nhiệm kỳ của Tòa án bằng với nhiệm kỳ của cơ quan đại diện. Nhiệm vụ chính của Tòa án là xét xử các hành vi vi phạm pháp luật; bảo vệ chế độ nhà nước xã hội chủ nghĩa cũng như bảo đảm cuộc sống của nhân dân (điều 156); các phiên tòa tại Cộng hòa dân chủ nhân dân Triều Tiên được tiến hành bởi một hội đồng xét xử bao gồm ba người trong đó có một Thẩm phán và hai Hội thẩm nhân dân; tuy nhiên Hiến pháp cũng quy định rõ trong trường hợp đặc biệt thì thành phần Hội đồng xét xử có thể chỉ có ba thẩm phán (điều 157).
Hoạt động xét xử của các Tòa án tại Cộng hòa dân chủ nhân dân Triều Tiên được xét xử theo nguyên tắc công khai; tuy nhiên trong những trường hợp cụ thể thì Tòa án vẫn có thể xét xử kín; ngôn ngữ được sử dụng tại Tòa là tiếng Triều Tiên; tuy nhiên người nước ngoài có quyền sử dụng ngôn ngữ của nước mà họ mang quốc tịch khi tham gia tố tụng tại tòa. Tòa án của Cộng hòa dân chủ nhân dân Triều Tiên cũng như Tòa án của Việt Nam luôn coi nguyên tắc độc lập là một trong những nguyên tắc hoạt động cơ bản của mình (điều 158,159,160).
Tòa án trung ương là Tòa án tối cao của Cộng hòa dân chủ nhân dân Triều Tiên; đây cũng là cơ quan xét xử cao nhất của đất nước. Ngoài hoạt động xét xử thì Tòa án trung ương còn có quyền giám sát hoạt động của tất cả các Tòa án dưới nó (điều 161)
Hiến pháp Cộng hòa dân chủ nhân dân Triều Tiên khẳng định chức năng điều tra và truy tố được dành cho cho Văn phòng công tố[10]; Nhiệm kỳ của các văn phòng công tố cũng giống như nhiệm kỳ của Tòa án đó là giống như nhiệm kỳ của các Hội đồng địa phương.
Các văn phòng công tố có những nhiệm vụ cụ thể được quy định tại điều 150 của Hiến pháp như: Giám sát các văn bản quy phạm pháp luật do các cơ quan nhà nước ban hành đảm bảo rằng các văn bản này hoàn toàn phù hợp với pháp luật do Quốc hội ban hành; cũng như phù hợp với các văn bản do cơ quan quyền lực nhà nước ban hành (bảo đảm tính thống nhất của pháp luật)
Các văn phòng công tố thực hiện thẩm quyền điều tra dưới sự chỉ dạo và kiểm soát chặt chẽ của văn phòng công tố Trung ương (điều 151).

CONSTITUTION OF DEMOCRATIC PEOPLE'S REPUBLIC OF KOREA

The great leader Comrade Kim Il Sung is the founder of the DPRK and the socialist Korea. Comrade Kim Il Sung founded the immortal Juche idea, organized and guided an anti-Japanese revolutionary struggle under its banner, created revolutionary tradition, attained the historical cause of the national liberation, and founded the DPRK, built up a solid basis of construction of a sovereign and independent state in the fields of politics, economy, culture and military, and founded the DPRK. Comrade Kim Il Sung put forward an independent revolutionary line, wisely guided the social revolution and construction at various levels, strengthened and developed the Republic into a people-centered socialist country and a socialist state of independence, self-sustenance, and self-defense. Comrade Kim Il Sung clarified the fundamental principle of State building and activities, established the most superior state social system and political method, and social management system and method, and provided a firm basis for the prosperous and powerful socialist fatherland and the continuation of the task of completing the Juche revolutionary cause. Comrade Kim Il Sung regarded "believing in the people as in heaven" as his motto, was always with the people, devoted his whole life to them, took care of and guided them with a noble politics of benevolence, and turned the whole society into one big and united family. Comrade Kim Il Sung, while turning the Republic into a mighty fortress for national reunification, indicated fundamental principles and methods for national reunification, developed the national reunification movement into a pan-national movement, and opened up a way for that cause, to be attained by the united strength of the entire nation. The great leader Comrade Kim Il Sung made clear the fundamental idea of the Republic 's external policy, expanded and developed diplomatic relations on this basis, and heightened the international prestige of the Republic. Comrade Kim Il Sung as a veteran world political leader, hew out a new era of independence, vigorously worked for the reinforcement and development of the socialist movement and the nonaligned movement, and for world peace and friendship between peoples, and made an immortal contribution to the mankind 's independent cause. Comrade Kim Il Sung was a genius ideological theoretician and a genius art leader, an ever-victorious, iron-willed brilliant commander, a great revolutionary and politician, and a great human being. Comrade Kim Il Sung 's great idea and achievements in leadership are the eternal treasures of the nation and a fundamental guarantee for the prosperity and efflorescence of the DPRK. The DPRK and the entire Korean people will uphold the great leader Comrade Kim Il Sung as the eternal President of the Republic, defend and carry forward his ideas and exploits and complete the Juche revolution under the leadership of the Workers ' Party of Korea. The DPRK Socialist Constitution is a Kim Il Sung constitution which legally embodies Comrade Kim Il Sung 's Juche state construction ideology and achievements. Chapter 1 Politics Article 1 The Democratic People 's Republic of Korea is an independent socialist state representing the interests of all the Korean people. Article 2 The DPRK is a revolutionary state which has inherited brilliant traditions formed during the glorious revolutionary struggle against the imperialist aggressors, in the struggle to achieve the liberation of the homeland and the freedom and well-being of the people. Article 3 The DPRK is guided in its activities by the Juche idea, a world outlook centered on people, a revolutionary ideology for achieving the independence of the masses of people. Article 4 The sovereignty of the DPRK resides in the workers, peasants, working intellectuals and all other working people. The working people exercise power through their representative organs -- the Supreme People 's Assembly and local people 's assemblies at all levels. Article 5 All the State organs in the DPRK are formed and function on the principle of democratic centralism. Article 6 The organs of State power at all levels, from the county People's Assembly to the SPA, are elected on the principle of universal, equal and direct suffrage by secret ballot. Article 7 Deputies to the organs of State power at all levels have close ties with their constituents and are accountable to them for their work. The electors may recall the deputies they have elected if the latter are not to be trusted. Article 8 The social system of the DPRK is a people-centered system under which the working people are masters of everything, and everything in society serves the working people. The State shall defend and protect the interests of the workers, peasants and working intellectuals who have been freed from exploitation and oppression and become masters of the State and society. Article 9 The DPRK shall strive to achieve the complete victory of socialism in the northern half of Korea by strengthening the people 's power and vigorously performing the three revolutions -- the ideological, cultural and technical -- and reunify the country on the principle of independence, peaceful reunification and great national unity. Article 1 The DPRK bases itself on the political and ideological unity of the entire people based on the worker-peasant alliance in which the working class plays a leading role. The State strengthens the ideological revolution and revolutionizes and working-classizes all the social members, and binds the whole society in a united group, linked up with comradeship. Article 11 The DPRK shall conduct all activities under the leadership of the Workers ' Party of Korea. Article 12 The State shall adhere to the class line, strengthen the dictatorship of people 's democracy and firmly defend the people's power and socialist system against all subversive acts of hostile elements at home and abroad. Article 13 The State shall implement the mass line and apply the Chongsanri spirit and Chongsanri method to all its activities, the spirit and method by which superiors assist their subordinates, mix with the masses to find solutions to problems and rouse them to conscious enthusiasm preferentially through political work, with people. Article 14 The State shall powerfully conduct the Three- Revolution Red Flag Movement and other mass movements and accelerate the building of socialism to the maximum. Article 15 The DPRK shall champion the democratic, national rights of Koreans overseas and their rights recognized by the international law. Article 16 The DPRK shall guarantee the legal rights and interests of foreigners in its region. Article 17 Independence, peace, and solidarity are the basic ideals of the foreign policy and the principles of external activities of the DPRK. The State shall establish diplomatic as well as political, economic and cultural relations with all friendly countries, on principles of complete equality, independence, mutual respect, noninterference in each other 's affairs and mutual benefit. The State shall promote unity with the world public defending peoples who oppose all forms of aggression and interference and fight for their countries ' independence and national and class emancipation. Article 18 The law of the DPRK reflects the wishes and interests of the working people and is a basic instrument for State administration. Respect for the law and its strict adherence and execution is the duty of all institutions, enterprises, organizations and citizens. The State shall perfect the system of socialist law and promote the socialist law-abiding life. Chapter 2 Economy Article 19 The DPRK relies on the socialist production relations and on the foundation of an independent national economy. Article 2 In the DPRK, the means of production are owned only by the State and social cooperative organizations. Article 21 The property of the State belongs to the entire people. There is no limit to the property which the State can own. Only the State possesses all the natural resources, railways, airports, transportation, communication organs and major factories, enterprises, ports and banks. The State shall guarantee giving priority to the growth of its property which plays a leading role in the development of the national economy. Article 22 The property of social cooperative organizations belongs to the collective property of working people within the organizations concerned. Social cooperative organizations can possess such property as land, agricultural machinery, ships, medium-small sized factories and enterprises. The State shall protect the property of social cooperative organizations. Article 23 The State shall enhance the ideological consciousness and the technical and cultural level of the peasants, increase the role of the property of the entire people in leading the cooperative property so as to combine the two forms of property systematically, shall consolidate and develop the socialist cooperative economic system by improving the guidance and management of the cooperative economy and gradually transform the property of cooperative organizations into the property of the people as a whole based on the voluntary will of all their members. Article 24 Private property is confirmed to property meeting the simple and individual aims of the citizen. Private property consists of socialist distributions of the result of labor and additional benefits of the State and society. The products of individual sideline activities including those from the kitchen gardens of cooperative farmers and income from other legal economic activities shall also belong to private property. The State shall protect private property and guarantee its legal inheritance. Article 25 The DPRK regards the steady improvement of the material and cultural standards of the people as the supreme principle of its activities. The constantly-increasing material wealth of society in our country, where taxes have been abolished, is used entirely for promoting the well-being of the working people. The State shall provide all working people with every condition for obtaining food, clothing and housing. Article 26 The independent national economy of the DPRK is a solid foundation for the people 's happy socialist life and for the prosperity of the fatherland. The State, holding fast to the line of building an independent national economy, shall accelerate Juche-orientation, modernization and scientific sophistication of the national economy, develop the national economy into a highly developed Juche-oriented one, strive to build a solid material and technical foundation commensurate with a complete socialist society. Article 27 The technical revolution is vital to the development of the socialist economy. The State shall perform all economic activities by giving top priority to solving the problem of technical development, push vigorously ahead with a mass technical revolution movement by accelerating scientific and technical development and the technical innovation of the national economy, free the working masses from backbreaking labor and narrow down the differences between physical and mental labor. Article 28 The State shall accelerate the technical revolution in the rural areas in order to eliminate differences between urban and rural areas, and class distinctions between the working class and the peasantry, industrialize and modernize agriculture, strengthen the guidance and assistance to rural areas by enhancing the role of the county. The State shall undertake, at its own expense, the building of production facilities for the cooperative farms and modern houses in the countryside. Article 29 Socialism and Communism are built by the creative labor of the working masses. In the DPRK, labor is an independent and creative work of the working masses, who have been freed from exploitation and suppression. The State renders the labor of our working people, who do not worry about unemployment, more joyful and worthwhile, so that they willingly work with enthusiasm and creativeness for society, organizations and for themselves. Article 3 The daily working hours of the working masses are eight hours. The State will decide to shorten the daily working hours depending on the hardness and special conditions of labor. The State shall organize labor effectively, strengthen labor rules and take fully utilize labor 's working hours. Article 31 In the DPRK, the minimum working age is 16 years old. The State shall prohibit child labor under the stipulated working age. Article 32 The State shall firmly adhere to the principle of properly combining political guidance with economic and technical guidance, the unified guidance of the State with the creativity of each unit, monolithic leadership with democracy, political and moral incentives with material incentives in the guidance and management of the socialist economy. Article 33 The State shall guide and manage the national economy according to the Taean Work System, which is a socialist economic management form whereby the economy is operated and managed in a scientific and rational way depending on the collective power of the producing masses, and according to the agricultural guidance system whereby agricultural management is conducted by industrial methods. The State shall introduce a cost accounting system in the economic management according to the demand of the Taean work system, and utilize such economic levers as prime costs, prices and profits. Article 34 The national economy of the DPRK is a planned economy. The State shall balance a proportion between accumulation and consumption properly, accelerate the economic construction, continue to raise people 's living standard and formulate and implement national economic development plans in order to strengthen the national defense capability. The State shall formulate unified and detailed plans and guarantee a high rate production growth and a balanced development of the national economy. Article 35 The DPRK shall compile and implement the State budget along with the national economic development plan. The State will intensify campaigns for increased production and expanded economy, carry out financial regulations strictly, increase the State 's savings, and expand and develop the socialist property. Article 36 In the DPRK, the State and social cooperative organizations shall conduct foreign trade activities. The State shall develop foreign trade on the principles of complete equality and mutual benefit. Article 37 The State shall encourage institutions, enterprises or associations of the DPRK to establish and operate equity and contractual joint venture enterprises with corporations or individuals of foreign countries within a special economic zone. Article 38 The State shall pursue a tariff policy with the aim of protecting the independent national economy. Chapter 3 Culture Article 39 Socialist culture, which is flourishing and developing in the DPRK, contributes to the improvement of the creative ability of the working people and to meeting their sound cultural and aesthetic demands. Article 4 The DPRK shall, by carrying out a thorough cultural revolution, train the working people to be builders of socialism and communism equipped with a profound knowledge of nature and society and a high level of culture and technology, thus making the whole of society intellectual. Article 41 The DPRK shall develop a truly popular, revolutionary culture which serves the socialist working people. In building a socialist national culture, the State shall oppose the cultural infiltration of imperialism and any tendency to return to the past, protect its national cultural heritage, and develop it in keeping with the existing socialist situation. Article 42 The State shall eliminate the way of life inherited from the outmoded society and establish a new socialist way of life in every sphere. Article 43 The State shall put the principles of socialist education into practice and raise the new generation to be steadfast revolutionaries who will fight for society and the people, to be people of a new communist type who are knowledgeable, morally sound and physically healthy. Article 44 The State shall give precedence to public education and the training of cadres for the nation and combine general education with technological education, and education with productive labor. Article 45 The State shall develop universal compulsory 11-year education which includes a compulsory one-year preschool education at a high level in accordance with the trend of modern science and technology and the practical requirements of socialist construction. Article 46 The State shall train competent technicians and experts by enhancing the regular educational system as well as different forms of study while working, and by improving the scientific and theoretical levels of technical education and education on social science and basic science. Article 47 The State shall provide education to all pupils and students free of charge and grant allowances to students of universities and colleges. Article 48 The State shall strengthen social education and provide the working people with all available conditions for study. Article 49 The State shall maintain all children of preschool age in creches and kindergartens at State and public expense. Article 5 The State shall establish Juche in scientific research, introduce advanced science and technology in every possible way, open up new areas of science and technology and raise the country 's science and technology to the world level. Article 51 The State shall draw up a proper plan for scientific research work, consolidate creative cooperation between scientists, specialists and producer masses. Article 52 The State shall develop a Juche-oriented, revolutionary literature and art, national in form and socialist in content. The State shall encourage creative workers and artists to produce works of high ideological and artistic value and enlist the working masses widely in literary and artistic activity. Article 53 The State shall provide sufficient modern cultural facilities to meet the demands of the people who want to continually improve themselves, both mentally and physically, so that the working people may enjoy a socialist cultured, aesthetic life to their hearts ' content. Article 54 The State shall safeguard our language from all attempts to obliterate it and shall develop it to meet present-day needs. Article 55 The State shall popularize physical culture and make it in a habit of people's life to make people fully prepared for labor and national defense; and develop physical technique conforming to the actual situation of our country and trends in the development of modern physical technique. Article 56 The State shallconsolidate and develop the system of universal free medical service, and consolidates the section doctor system and the system of preventive medicine to protect people's life and improve working people's health. Article 57 The State shall adopt measures to protect the environment in preference to production, preserve and promote the natural environment and prevent environmental pollution so as to provide the people with a hygienic environment and working conditions. Chapter 4 National Defense Article 58 The Democratic People 's Republic of K orea rests on the people 's nationwide defence system. Article 59 The mission of the armed forces of the DPRK is to safeguard the interests of the working people, to defend the socialist system and the gains of the revolution from aggression and to protect the freedom, independence and peace of the country. Article 6 The State shall implement the line of self-reliant defence, the import of which is to arm the entire people, fortify the country, train the army into a cadre army and modernize the army on the basis of equipping the army and the people politically and ideologically. Article 61 The State shall strengthen military and mass discipline in the army and promote the display of the noble traditional trait of unity between officers and men and unity between the army and the people. Chapter 5 Fundamental Rights and Duties of Citizens Article 62 The terms for becoming a citizen of the Democratic People 's Republic of Korea are defined by the Law on Nationality. A citizen is under the protection of the DPRK regardless of the domicile. Article 63 In the DPRK the rights and duties of citizens are based on the collectivist principle, One for all and all for one. Article 64 The State shall effectively guarantee genuine democratic rights and liberties as well as the material and cultural well-being of its citizens. In the DPRK the rights and freedom of citizens shall be amplified with the consolidation and development of the social system. Article 65 Citizens enjoy equal rights in all spheres of State and public activities. Article 66 All citizens who have reached the age of 17 have the right to elect and to be elected, irrespective of sex, race, occupation, length of residence, property status, education party affiliation, political views or religion. Citizens serving in the armed forces also have the right to elect and to be elected. A person who has been disenfranchised by a Court decision and a person legally certified insane do not have the right to elect or to be elected. Article 67 Citizens are guaranteed freedom of speech, of the press, of assembly, demonstration and association. The State shall guarantee conditions for the free activity of democratic political parties and social organizations. Article 68 Citizens have freedom of religious beliefs. This right is granted by approving the construction of religious buildings and the holding of religious ceremonies. No one may use religion as a pretext for drawing in foreign forces or for harming the State and social order. Article 69 Citizens are entitled to submit complaints and petitions. Complaints and petitions shall be investigated and dealt with according to procedure and within the period fixed by law. Article 70 Citizens have the right to work. All able-bodied citizens choose occupations in accordance with their wishes and skills and are provided with stable jobs and working conditions. Citizens work according to their abilities and are paid in accordance with the quantity and quality of their work. Article 71 Citizens have the right to relaxation. This right is ensured by the establishment of the working hours, the provision of holidays, paid leave, accommodation at health resorts and holiday homes at State expense and by a growing network of cultural facilities. Article 72 Citizens are entitled to free medical care, and all persons who are no longer able to work because of old age, illness or a physical disability, the old and children who have no means of support are all entitled to material assistance. This right is ensured by free medical care, an expanding network of hospitals, sanatoria and other medical institutions, State social insurance and other social security systems. Article 73 Citizens have the right to education. This right is ensured by an advanced educational system and by the educational measures enacted by the State for the benefit of the people. Article 74 Citizens are free to engage in scientific, literary and artistic pursuits. The State shall grant benefits to inventors and innovators. Copyright and patent rights shall be protected by law. Article 75 The citizens shall have freedom to reside in and travel to any place. Article 76 Revolutionary fighters, the families of revolutionary and patriotic martyrs, the families of soldiers of the People 's Army and disabled enjoy the special protection of the State and society. Article 77 Women are accorded an equal social status and rights with men. The State shall afford special protection to mothers and children by providing maternity leave, reduced working hours for mothers with many children, a wide network of maternity hospitals, creches and kindergartens, and other measures. The State shall provide all conditions for women to play a full role in society. Article 78 Marriages and the family shall be protected by the State. The State pays great attention to consolidating the family, the basic unit of social life. Article 79 Citizens are guaranteed inviolability of the person and the home and privacy of correspondence. No citizens can be placed under control or be arrested nor can their homes be searched without a legal warrant. Article 8 The DPRK shall grant the right of asylum to foreign nationals persecuted for struggling or peace and democracy, national independence and socialism for the freedom of scientific and cultural pursuit. Article 81 Citizens shall firmly safeguard the political and ideological unity and solidarity of the people. Citizens must value organizations and collectives, and must demonstrate the spirit of devoting themselves to the work for the society and the people. Article 82 Citizens shall strictly observe the laws of the State and the socialist standards of life and defend their honor and dignity as citizens of the DPRK. Article 83 Work is noble duty and honor of a citizen. Citizens shall willingly and conscientiously participate in work and strictly observe labor discipline and the working hours. Article 84 Citizens shall take good care of State and communal property, combat all forms of misappropriation and waste and manage the nation 's economy diligently as the masters. The property of the State and the social, cooperative organization is inviolable. Article 85 Citizens shall constantly increase their revolutionary vigilance and devotedly fight for the security of the State. Article 86 National defense is the supreme duty and honor of citizens. Citizens shall defend the country and serve in the army as required by law. Chapter 6 The Structure of the State Paragraph I) The Supreme People 's Assembly Article 87 The Supreme People 's Assembly is the highest organ of State power in the DPRK. Article 88 The SPA exercises legislative power. When the SPA is not in session, the SPA Presidium also can exercise legislative power. Article 89 The SPA is composed of deputies elected on the principle of universal, equal and direct suffrage by secret ballot. Article 9 The SPA is elected for a term of five years. A new election is held before the term expires according to the decision of the SPA Presidium. The term is extended if an election is not held due to unavoidable circumstances. Article 91 The SPA has the authority to: 1. amend and supplement the Constitution, 2. adopt, amend and supplement departmental laws, 3. approve major departmental laws adopted by the SPA Presidium in the intervals between the sessions of the SPA, 4. establish the basic principles of the State 's domestic and foreign policies, 5. elect or transfer the Chairman of the DPRK National Defense Commission, 6. elect or remove the President of the SPA Presidium, 7. elect or transfer the first vice-chairman, vice-chairmen and members of the National Defense Commission according to the recommendation of the Chairman of the DPRK National Defense Commission, 8. elect or transfer the vice-presidents, honorary vice presidents, secretary and members of the SPA Presidium, 9. elect or transfer the Premier of the Cabinet, 1. appoint the vice premiers of the Cabinet, chairmen of commissions, ministers and other members of the Cabinet according to the recommendation of the Premier of the Cabinet, 11. appoint or remove the Prosecutor-general, 12. elect or transfer the Chief Justice, 13. elect or transfer the chairmen, vice chairmen and members of the committees of the SPA, 14. examine and approve the State plan for the development of the national economy and a report on its fulfillment, 15. examine and approve a report on the State budget and on its implementation, 16. receive a report on the work of the Cabinet and national institutions and adopt measures, if necessary, 17. decide on the ratification or abrogation of treaties submitted to the SPA. Article 92 The SPA holds regular and extraordinary sessions. Regular sessions are convened once or twice a year by the SPA Presidium . Extraordinary sessions are convened when the SPA Presidium deems them necessary or at the request of a minimum of one-third of the total number of deputies. Article 93 The SPA requires a quorum of at least two-thirds of the total number of deputies in order to meet. Article 94 The SPA elects its Chairman and vice chairmen. The Chairman presides over the sessions. Article 95 An item on the agenda to be deliberated on by the SPA is submitted to the SPA Presidium, Cabinet and SPA committees. Article 96 Each of the first session of the SPA elects a Credentials Committee and, on hearing the Committee 's report, adopts a decision confirming the credentials of deputies. Article 97 The SPA adopts laws and decisions. Laws and decisions of the SPA are adopted when more than half of the deputies attending signify approval by a show of hands. The Constitution is amended and supplemented with the approval of more than two-thirds of the total number of deputies to the SPA. Article 98 The SPA sets up committees such as the legislation committee and the budget committee. The SPA committees consist of its chairman, vice chairmen and members. The SPA committees assist in the work of the SPA; they plan or deliberate on the State policy and bills and take measures for their implementation. When the SPA is not in session, committees operate under the guidance of the SPA Presidium. Article 99 Deputies to the SPA are guaranteed inviolability as such. No deputy to the SPA can be arrested or punished without the consent of the SPA or, when it is not in session, without the consent of the SPA Presidium, except for a flagrant offence. Paragraph II) The National Defense Commission Article 100 The National Defense Commission is the highest military leading organ of State power and an organ for general control over national defense. Article 101 The NDC consists of its Chairman, first vice chairman, vice chairmen and members. The term of the NDC Chairman is the same as that of the SPA. Article 102 The Chairman of the NDC directs and commands all the armed forces and guides defense affairs as a whole. Article 103 The NDC has the duties and authority to: 1. guide the armed forces and guide the State in defense building as a whole, 2. set up or abolish a national institution in the defense sector, 3. appoint or remove major military cadres, 4. set up military titles and confer the military rank of general and higher ranks, 5. proclaim a state of war and orders for mobilization. Article 104 The NDC issues decisions and orders. Article 105 The NDC is accountable to the SPA. Paragraph III) The SPA Presidium Article 106 The SPA Presidium is the highest organ of power in the intervals between sessions of the SPA. Article 107 The SPA Presidium consists of its Chairman, vice chairman, secretaries and members. Article 108 The SPA Presidium may appoint some honorary vice chairmen. The honorary vice chairmen may be those from among SPA deputies who have participated in State construction works for a long time and made a noticeable contribution. Article 109 The term of the SPA Presidium is the same as that of the SPA. The SPA Presidium continuously fulfill its duty after its term expires until a new SPA Presidium is elected. Article 110 The SPA Presidium has the duties and authority to 1. convene sessions of the SPA, 2. examine and adopt new departmental bills and regulations, raised when the SPA is in recess, and examine and adopt drafts of amendment and supplement to departmental bills and regulations in force, and receive approval from the next SPA session on important departmental bills which will be adopted and implemented, 3. examine and approve the State plan for the development of the national economy, the State budget and its adjusted plan, raised when the SPA is in recess due to unavoidable circumstances, 4. interpret the Constitution, departmental laws and regulations in force. 5. supervise the observance of laws of State organs, and adopt measures, 6. abolish State organs ' decisions which violate the Constitution, SPA 's laws and decisions, NDC 's decisions and orders and the SPA Presidium 's decrees, decisions and directions, and suspend the implementation of unwarranted decisions by a local people 's assembly, 7. do work for an SPA deputy election, and organize an election for deputies in a local people 's assembly, 8. do work with SPA deputies, 9. do work with SPA departmental committees, 1. form or abolish commissions and ministries of the Cabinet, 11. appoint or remove vice premiers, chairman, and Cabinet and ministry members upon a proposal by Premier when the SPA is in recess, 12. appoint or remove members of departmental committees of the SPA Presidium, 13. elect or transfer judges of the Central Court and people 's assessors, 14. ratify or abrogate treaties concluded with other countries, 15. decide on and publish the appointment or recall of diplomatic envoys accredited to foreign countries, 16. institute a decoration, a medal, an honorary title and a diplomatic rank, and grant a decoration, a medal, and an honorary title, 17. exercise the right to grant general amnesties or special pardon, 18. institute and reorganize an administration unit and district. Article 111 The President of the SPA Presidium organizes and guides the work of the presidium. The President of the SPA Presidium represents the State and receives credentials and letters of recall of diplomatic representatives accredited by a foreign state. Article 112 The SPA Presidium convenes a plenary meeting and an executive meeting. The plenary meeting consists of all the members and the executive meeting of the President, vice presidents, and secretary. Article 113 The SPA Presidium 's plenary meeting deliberates on and adopts important issues for the Presidium to implement its duties and authority. The executive meeting deliberates on and adopts issues which are entrusted to it by the plenary meeting. Article 114 The SPA Presidium issues decrees, decisions and directions. Article 115 The SPA Presidium may set up its assistant departmental committees. Article 116 The SPA Presidium is accountable to the SPA. Paragraph IV) Cabinet Article 117 The Cabinet is the administrative and executive body of the highest organ of State power and a general state management organ. Article 118 The Cabinet consists of the Premier, vice premiers, chairmen of commissions, ministers and some other necessary members. The Cabinet 's term is the same as that of the SPA. Article 119 The Cabinet has duties and authority to: 1. adopt measures to execute state policy, 2. institute, amend, and supplement regulations concerning state management based on the Constitution and departmental laws, 3. guide the work of the Cabinet commissions, ministries, direct organs of the Cabinet, local people 's committees, 4. set up and remove direct organs of the Cabinet, main administrative economic organizations, and enterprises, and adopt measures to improve the State management structure, 5. draft the State plan for the development of the national economy and adopt measures to put it into effect, 6. compile the State budget and adopt measures to implement it, 7. organize and exercise works in the fields of industry, agriculture, construction, transportation, communications, commerce, trade, land management, city management, education, science, culture, health, physical training, labor administration, environmental protection, tourism and others, 8. adopt measures to strengthen the monetary and banking system, 9. do inspection and control work to establish a state management order, 1. adopt measures to maintain social order, protect State and social cooperation body 's possession and interests, and to guarantee citizens ' rights, 11. conclude treaties with foreign countries, and conduct external activities, 12. abolish decisions and directions by economic administrative organs, which run counter to the Cabinet decisions or directions, Article 120 The Premier of the Cabinet organizes and guides the work of the Cabinet. The Premier represents the government of the DPRK. Article 121 The Cabinet convenes a plenary meeting and an executive meeting. The plenary meeting consists of all the Cabinet members and the executive meeting of the Premier, vice premier and other Cabinet members whom the Premier nominates. Article 122 The Cabinet plenary meeting deliberates on and adopts new and important issues in economic administrative work. Article 123 The Cabinet adopts decisions and directions. Article 124 The Cabinet may set up non-permanent departmental committees which assist in its works. Article 125 The Cabinet is accountable to the SPA, and to the SPA Presidium when the SPA is in recess. Article 126 The newly elected Premier of the Cabinet makes an oath in the SPA, representing Cabinet members. Article 127 The Cabinet commission and ministries are departmental executive organs, and departmental management organs. Article 128 The Cabinet commissions and ministries grasp, guide and manage the work in charge, under the guidance of the Cabinet. Article 129 The Cabinet commissions and ministries manage committee assemblies and cadres assemblies. Commission and ministry committee assemblies and cadres assemblies deliberate on and adopt measures to exercise Cabinet decisions, and directions and other important issues. Article 130 The Cabinet commissions and ministries issue directions. Paragraph V) Local People's Assembly Article 131 Provincial (or municiparity directly under the central authority), municipal (district), and county local people 's assemblies are local sovereign power organs. Article 132 The LPA consists of deputies elected on the principle of universal, equal and direct suffrage by secret ballot. Article 133 The term of provincial (or municipality directly under the central authority), municipal (district), and county local people 's assemblies are four years. A new election of the LPA is held according to a decision of a Local People 's Committee (LPC) at the corresponding level before the LPA 's term expires. Article 134 The LPA has the duties and authority to: 1. deliberate on and approve a report on local plans for the development of the national economy, and their implementation, 2. deliberate on and approve a report on a local budget and its execution, 3. adopt measures to exercise State laws in the area concerned, 4. elect or recall the chairman, vice chairmen, secretary of the people 's committee at the corresponding level, 5. elect or recall judges of a court and people 's assessors, 6. abolish unwarranted decisions and directions adopted by a people 's committee, and a lower people 's assembly. Article 135 The LPA convenes a regular assembly and an extraordinary assembly. The regular assembly is convened once or twice in a year by an LPC at the corresponding level. The extraordinary assembly is held when the people 's committee at the corresponding level deems it necessary or at the request of a minimum of one-third of the total numbers of deputies. Article 136 The LPA forms a quorum when the two-third of the deputies participate in it. Article 137 The LPA elects its chairman. Article 138 The LPA issues its decisions. Paragraph VI) Local People's Committee Article 139 Provincial (or municipality directly under the central authority), municipal (district), and county local people 's committees are local sovereign power organs when the corresponding LPAs are in recess, and are administrative executive organs of local sovereignty. Article 14 The LPC consists of its chairman, vice chairmen, secretaries and members. The term of LPC is the same as that of the LPA. Article 141 The LPC has the duties and authorities to: 1. convene a people 's assembly, 2. do preparatory work for the election of a local assembly, 3. do work with deputies of a people 's assembly, 4. exercise laws, decrees, decisions and directions of the people 's assembly at the corresponding level, upper people 's assemblies, people 's committees, and the Cabinet, Cabinet commissions, and ministries, 5. organize and exercise all the administrative work in the area concerned, 6. draft a local plan for the development of the national economy and adopt measures to put it into effect, 7. compile a local budget and adopt measures to put it into effect, 8. adopt measures to maintain social order in the area concerned, protect the property and interests of the State and social cooperative organizations, and to guarantee citizens ' rights, 9. do inspection and control work to establish order in state management in the area concerned, 1. guide the lower people 's committees in its work, 11. abolish unwarranted decisions and direction adopted by a lower people 's committee, and suspend implementation of unwarranted decisions made by a lower people 's committee. Article 142 The LPC convenes a plenary meeting and an executive meeting. The plenary meeting consists of all the LPC members, and the executive meeting of the chairman, vice chairmen, and secretary. Article 143 The plenary meeting deliberates on and adopts important issues for the LPC to implement its duties and authority. Article 144 The LPC issues decisions and directions. Article 145 The LPC may set up non-permanent departmental committees which assist in its works. Article 146 The LPC is accountable to the LPA at the correspondent level. The LPC is subordinate to the upper people 's committees and the Cabinet. Paragraph VII) Public Procurators ' Office and Court Article 147 Justice is administered by the Central Court, the Court of the province (or municipality directly under the central authority), municipal and county courts and the Special Court. Article 148 The term of office of the President of the Central Court is the same as that of the SPA. Article 149 The Central Procurators ' Office appoints and recalls a public procurator. Article 15 The functions of the Public Procurators ' Office are to: 1.ensure the strict observance of laws by institutions, enterprises, organizations and by citizens, 2. ensure that decisions and directives of State bodies conform with the Constitution, the SPA 's laws and decisions, the NDC 's decisions and orders, the SPA Presidium 's decrees, decisions, and directions, and the Cabinet decisions. 3. expose and institute legal proceedings against criminals and offenders in order to protect the State power of the DPRK, the socialist system, the property of the State and social, cooperative organizations and personal rights as guaranteed by the Consitution and the people 's lives and property. Article 151 Investigation are prosecution are conducted under the unified direction of the Central Public Procurators' Office, and all Public Procurators Offices are subordinate to their higher offices and the Central Procurators ' Office. Article 152 The Central Procurators' Office is accountable to the SPA, and to the SPA Presidium when the SPA is in recess. Article 153 Justice is administered by the Central Court, Provincial (or municipality directly under the central authority) Court, People's Court or by the Special Court. Verdicts are delivered in the name of the DPRK. Article 154 The term of director of the Central Court is the same as that of the SPA. The term of judges of the Central Court, Provincial (or municipality directly under the central authority) Court, People's Court, and that of the people's assessors are the same as that of the people's assembly at the corresponding level. Article 155 The Central Court appoints and removes the director and judges of the Special Court. People 's assessors of the Special Court are elected by soldiers of the unit concerned or by employees at their meetings. Article 156 The court has the duties to: 1. protect through judicial procedure the State power and the socialist system established in the DPRK, the property of the State and social, cooperative organizations, personal rights as guaranteed by the Constitution, and the lives and property of citizens, 2. ensure that all institutions, enterprises, organizations and citizens abide strictly by State laws and staunchly combat class enemies and all law-breakers; 3.give judgements and findings with regard to property and conduct notarial work. Article 157 A trial is conducted by a court which consists of one judge and two people 's assessors. In a special case, the court may consists of three judges. Article 158 Court cases are heard in public and the accused is guaranteed the right of defence. Hearings may be closed to the public as stipulated by law. Article 159 Judicial proceedings are conducted in the Korean language. Foreign citizens may use their own language during court proceedings. Article 16 In administering justice, the Court is independent, and judicial proceedings are carried out in strict accordance with the law. Article 161 The Central Court is the supreme court of the DPRK. The Central Court supervises trial activities of all courts. Article 162 The Central Court is accountable to the SPA, and to the SPA Presidium when the SPA is in recess. Chapter 7 National Emblem, Flag, National Anthem and Capital Article 163 The national emblem of the DPRK bears the design of a grand hydroelectric power station under Mt. Paektu, the sacred mountain of the revolution, and the beaming light of a five-pointed red star, with ears of rice forming an oval frame, bound with a red ribbon bearing the inscription The Democratic People's Republic of Korea. Article 164 The national flag of the DPRK consists of a central red panel, bordered both above and below by a narrow white stripe and a broad blue stripe. The central red panel bears a five-pointed red star within a white circle near the hoise. The ratio of the width to its length is 1:2. Article 165 The national anthem of the DPRK is the Patriotic Song. Article 166 The capital of the DPRK is Pyongyang.
